The Construction Act gives most parties to construction contracts a statutory right to payment. Applications for payment, payment notices and pay less notices must be issued in accordance with the relevant contractual and statutory requirements. Where an application for payment has been made in accordance with the contract and the paying party has not submitted a payment notice or pay less notice in accordance with the relevant statutory and contractual provisions, then that application for payment may be due in full on a ‘default’ basis.
