The Construction Act gives most parties to construction contracts a statutory right to payment. Where an application for payment has been made in accordance with the contract and the paying party has not submitted a payment notice or pay less notice in accordance with the relevant statutory and contractual provisions, then that application for payment may be due in full on a ‘default’ basis.
