Typically, the dispute is not just about the extension of time itself but also about when completion of the work should have taken place, when it actually took place, liability for liquidated damages or liability for common law damages. Disputes about extensions of time are much more common as the construction industry moves into recession.
All standard form contracts have an extension of time clause, or a compensation event clause. Some non standard form contracts do not have an extension of time clause. The existence or otherwise of an extension of time clause, and what it actually says, has a big impact on the rights of the Employer, the Contractor and the Sub-Contractor.
